SECTION 1 - ORDER TERMS

By agreeing to these Terms of Service, you declare that you are at least the age of 18 and you have given us your consent to allow any of your minor dependents to use this site. You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws). You must not transmit any worms or viruses or any code of a destructive nature. A breach or violation of any of the Terms will result in an immediate termination of your Services.

1.1 Validity of Contract

By making a purchase from us, you declare that you are at least the age of 18 and have the legal capacity or, in the absence thereof, have the parental authorization enabling you to enter into the contract. If not, in order to settle a possible dispute, we reserve the right to contact the person(s) having the parent care or your deputy directly. We will, therefore, be authorized, but not limited to, to require that the person(s) having the parent care or your deputy settles all orders placed by you.

For other types of agreements, please contact us before completing your purchase. As soon as the order has been placed by you, we will send out a confirmation email to the email address you have provided. It is your responsibility to provide a functioning address and check the order confirmation thoroughly for possible errors. It is important that you contact us immediately in case you wish to change or correct any details in your order. Once the production of a custom-tailored or a custom-made barong has started, no further changes can be applied. Information about the status of your order will be sent to the email address you have provided. As soon as the order has been shipped, a confirmation email containing possible tracking links is sent to your email. Upon the receipt of the goods through the customer, the contract is regarded as concluded.

2.1 Ordering Method

You can order in two ways:

Through our online store. Once you have your system-generated order number, you will automatically receive a notification from us every time we update your order in our system.

Through our customer support. This is applicable for orders that cannot be addressed by the solutions available on our online store. A detailed quote with specific product details and order fulfillment cycle time will be provided to you as well as an electronic invoice through which you can confirm your order and pay using an available payment method. Once you have your system-generated order number, you will automatically receive a notification from us every time we update your order in our system.

2.2 Order

The product images shown are for illustration purposes only. The products are made from fabrics with varying degrees of transparency which is why important details such as color and texture are greatly affected by factors such as lighting, the type of device used in capturing the images, and the post-processing done. Furthermore, the perception of designs, colors, and textures can vary from display to display. The actual products may vary somewhat in construction, texture, and color as determined by the fabric, type of thread, type of thread work, and the techniques applied. Therefore, the images do not refer to an exact representation but have a guiding function only.

2.3 Prices

The prices displayed on this website already include taxes.

2.4 Payment

All prices are quoted in Philippine Peso (PHP), our domestic currency. All payments due shall be made in PHP. Any prices quoted in currencies other than PHP are provided solely for the purpose of quick conversion, and should be considered as indicative rates only. In the event that the payment is made from an account denominated in a currency other than PHP, the actual payment amount shall be determined by the payment gateway's exchange rate at the time of payment.

Confirming a custom order requires a deposit of 50% of the total quote if the total quote exceeds PHP 20,000 (approximately USD 365; CAD 475; AUD 525; GBP 295; EUR 350). If the total quote is less than this amount or if the fulfillment time is less than five (5) weeks, full payment is required. While we ensure accuracy, we reserve the right to correct any pricing, typographical, or other errors, and to cancel or refuse to accept any order based on an incorrect price or description. Such corrections or cancellations may be made even after an order is accepted.

Once your order transitions to the production phase, an email notification will be sent to you. During this stage, the possibility of making changes to your order may vary depending on the specific nature of the change and the timing of the request. If you decide to cancel the order, please be aware that your deposit or 50% of the full payment, whichever is applicable, will be forfeited. If you have made a deposit to confirm your order, we will send you a statement of account indicating your outstanding balance.

The following payment methods are available:

• PayPal. PayPal handles and protects all sensitive credit/debit card information. No extra charges apply.
• Credit or Debit Card. You can also pay through PayPal using your Credit Card or Debit Card without a PayPal account. Just select PayPal in the payment method and click "Complete order." You will be redirected to PayPal to complete your purchase securely. On the PayPal page, select "Pay with debit or credit card." If PayPal does not allow your country of residence to ship to the country you wish to, please try a different payment method.
• Fund Transfer (Online or Over-the-Counter). The payment instructions will be provided to you after completing the checkout process.

2.5 Shipping

Our products have unique characteristics, and making them is time-consuming. Hand-embroidered pieces, in particular, require a significant amount of time to be made. Hence, we only ship using express courier services to guarantee faster and more secure delivery of goods. This method allows us to deliver products to domestic destinations in one to two (1-2) business days and to international destinations in three to five (3-5) business days.

Shipping across the Philippines is FREE on orders over PHP 5,000. For overseas shipping, the cost depends on the quantity, pouch or box size, weight, declared value, and destination country. A package of one barong has a shipping cost ranging from PHP 1,400-4,000 (approximately USD 25-73, CAD 34-98, AUD 38-108, GBP 21-60, or EUR 24-69). A package of five barongs has a shipping cost ranging from PHP 4,800-8,300 (approximately USD 87-151, CAD 117-202, AUD 130-224, GBP 72-124, or EUR 83-143). A package of more than five barongs has a shipping cost ranging from PHP 8,300-22,500 (approximately USD 151-409, CAD 202-549, AUD 224-608, GBP 124-336, or EUR 143-388).

You will receive an email with a tracking number as soon as your order is processed for shipment.

When importing goods, the destination country imposes customs duties and taxes if the value of the goods surpasses the minimum threshold (known as the de minimis value) it has established.. You are responsible for paying any inbound charges which your local customs authority deems appropriate. To find the de minimis value by country, please visit https://www.trade.gov/de-minimis-value. Customs policies and import duties vary widely from country to country so it would be a good idea to contact your local customs office for information. If customs duties are to be paid, the courier will inform you ahead of the delivery.

2.6 Delivery

Custom orders using ready-made materials normally take two to three (2-3) weeks to deliver worldwide.

Custom orders from the ground up normally take five to twenty (4-20) weeks depending on the intricacy of design, type of embroidery (whether pure hand, hand and machine, or machine), and production queues. Please keep our lead time in mind before placing an order.

2.7 Right of Withdrawal

You have the right to reject your ready-made products purchased from us. In case of withdrawal, please send us an email to support@heritagebarong.com. The right of refusal is valid only if the items are returned in an unaltered state within seven (7) days from the day the goods are received. Custom-made barongs are covered by our perfect fit guarantee.

We have identified the specific measurement figures and photos that we require from our customers to make sure that our products will fit properly. While we do our best to determine the proper measurement using the information that a customer provides, we are not responsible for any ill-fitting products resulting from the submission of incomplete requirements or from the submission of requirements that do not follow our instructions and the manner they are illustrated. If your measurement figures and photos are incomplete or not aligned with our instructions and illustrations, we will let you know so you will have the opportunity to correct and complete them.
